A Bill Collector Has Threatened To Garnish My Social Security Benefits What Can I Do?

First and foremost, we are not providing legal advice; we are only making some general observations. Anytime a bill collector makes such a threat, they have probably violated the Fair Debt Collection Practices Act (FDCPA). My suggestion is that you read the FDCPA in its entirety to find out what your rights are. Even if you owe a creditor and your payment is delinquent, you still have some powerful rights. It is unfortunate but all most all bill collectors will cross the line and violate a debtor’s rights just to collect a past due account. Having shared that, a bill collector cannot garnish your Social Security benefits no matter what they say. The only entities that may garnish your Social Security Benefits is the Internal Revenue Service to recover back taxes and the Federal Government may garnish Social Security Benefits to pay delinquent student loans guaranteed by the Federal Government.
